FIR Registered on ACP Vivek Bhagat’s Complaint, Independent Journalist Rosie Among Those Accused (Pankaj Rai)
New Delhi: The controversy surrounding the protest held at Jantar Mantar on October 3 in the national capital has now taken a legal turn. An FIR was registered at Parliament Street Police Station on October 13 following a complaint by Assistant Commissioner of Police (ACP) Vivek Bhagat. The complaint accuses independent journalist Rosie Gajendra Singh and some members of the Cockroach Janata Party of making caste-based remarks, publicly humiliating him, obstructing government work and allegedly damaging his reputation on social media. Police are investigating the matter.
According to the complaint, ACP Vivek Bhagat was responsible for maintaining law and order during a protest against the Election Commission held at Jantar Mantar on October 3. During the protest, near Buta Singh Roundabout, independent journalist Rosie allegedly made derogatory remarks about his caste and questioned his appointment as an ACP. Vivek Bhagat alleged that he ignored the remarks and continued performing his official duties.
The complaint further alleges that at around 3 pm, while police were attempting to control and detain protesters, Rosie accused the ACP of sexual harassment. According to Bhagat, Rosie and the people accompanying her repeatedly confronted him, obstructing him in the discharge of his official duties.
According to the complaint, Rosie and others staged a protest outside Parliament Street Police Station that evening and raised slogans against the ACP. Vivek Bhagat alleged that derogatory language was used against him during the protest and that he was described as a “sexual predator” and a “potential rapist.” These allegations have yet to be independently verified.
In his complaint, the ACP alleged that Rosie, Gajendra Singh and some members of the Cockroach Janata Party circulated posts and reels on social media concerning the allegations against him. The complaint reportedly names Rosie Gajendra Singh, Abhijeet Deepke, Ashutosh Ranka, Saurav Das and Ratna Singh.
The complainant claimed that these activities caused him mental distress and damaged his social and professional reputation.
According to the available summary of the complaint, the FIR invokes provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and Sections 221, 356(2) and 3(5) of the Bharatiya Nyaya Sanhita (BNS), among other relevant provisions. These provisions relate to allegations involving caste-based atrocities, obstruction of a public servant in the discharge of official duties, defamation and common intention, respectively.
The complaint also states that a separate complaint filed by Rosie alleging sexual harassment had been forwarded to the Delhi Police Crime Branch and was under investigation.
An impartial investigation into the allegations made by both sides is crucial. The allegations in the FIR registered on the basis of ACP Vivek Bhagat's complaint remain under investigation. The naming of a person in an FIR does not, by itself, establish guilt. Further action in the case will depend on the findings of the investigation and the available evidence.
